Regulations for persons with disabilities: Now begins to fight to qualify the workforce

According to the new inclusion law, it will be an advantage for people in this segment who enter the labor market, it is “binding compensation” to help the person stay before living, with the employment of a “healthcare provider”, but there is still more specific regulation. A reserve of 10% of vacancies in selection of a degree at higher education courses for people with disabilities is also planned. The new rules also define a penalty of one to three years for discrimination. The number of registration of people with disabilities in regular schools has grown more than 400% over the past 12 years in Brazil, from 145,000 2003 to 698,000 in 2014. In the last five years, another 214,000 notifications of special students have been registered in regular classes. In the federal network for higher education, this index quintured: from 3,705 students to 19,812 last year.

According to Walter Borges Dos Santos, general coordinator for accessibility policy at the School of Continuing Education, Literacy, Diversity and Inclusion (Secadi) for the Ministry of Education, is the increase in an inclusive policy. “The right to specialized education was strengthened with the legislation from 2012 and stipulated that public and private systems for basic and higher education ensure notification,” he says. The coordinator refers to Article 7 of the Act 12.764 from 2012, which determines the penalty for the head of the school or the competent authority who refuses to sign up to a student with autistic spectrum or any other type of disability. Another legislative advance was Article 5 of Decree No 8 368 from 2014, which regulates the application of penalties to those who do not comply with.

Between 2011 and 2014, approximately 153,000 people with disabilities in the labor market affected through direct action by the inspection. According to data from the latest annual relationship between social information (RAIS), 27.5 thousand new jobs were created for people with disabilities in 2013, which represented an increase of 8.33%, in the participation of this group in the labor market. With the result, the number was reached 357.8 thousand. Men represent 64.84% of employees, while women with disabilities occupy 35.16% of vacancies. However, some arrive without proper qualification and the improvement of the work hand is in practice given by everyday life between the manager and the employee.
