Minister Luiz Edson Fachin from the Supreme Court (STF), in the second case refused to apply for Corpus Habeas submitted by the defense of Rúbia Joice from Oliver Luvisetto, this week, maintaining the arrest of 22 years. She is accused of participating in the murder of her ex-boyfriend, 19-year-old Hugo Vinícius Pedrosy at dawn on June 25, 2023 in Seven Falls, 468 kilometers from Campo Grande.
In this decision, Fachin stated that “pointed illegality cannot be prepared” and emphasized that maintaining pre -setting arrest is possible when there is “concrete gravity of proceedings”. The minister considered the way the crime was committed, with evidence of danger. According to the files of the case, Hugo was shot, taken to the ranch, killed with a new shooting, covered and hid his body in the river.
The application for freedom came to the Supreme Court after the negatives in the lower courts, including Mato Grosso to Sul Court I STJ (Supreme Court). The office of the Prosecutor General was called to speak. This process is still underway, but Rúbia will remain trapped.
He has been accused in custody from June 13, 2024 in the Goioer (PR) prison. In November of the same year, her defense asked to transfer Mato Grosso to Sul to the prison unit, claiming that she should remain close to her grandparents, who often visit her and are old.

All three would develop a plan to kill Hugo. The victim was attracted by Rúbia to his house, in which Danilo fired at the first shot. Danilo remained a fugitive for two months, until he was in Iguatemi (MS), about seven o’clock. Rúbia introduced himself to the police twice, being the last in Paraná, where he lived.
The court ordered that three, in addition to two other accused, go to a trial for qualified murder through cruel and hidden corpses.
