Judge orders us to get the migrant deported “by mistake” to El Salvador

On Friday, US justice ordered that the Trump administration is expected to return to the United States, within three days, a Maryland man who was incorrectly deported to El Salvador last month.

District judge Paula Xinis in Greenbelt, Maryland, said in a court hearing that the government should take measures to ensure the return of Kilmar Abreco Garcia, a rescue migrant, to the United States until April 7.

The United States has already realized that Vugo Garcia, who legally lived in the United States and had a work permit, was accidentally deported, but claimed that he has no legal authority to bring him back to the country.

One of the lawyers in Abreco Garcia, Simon Sandoval-Moshenberg, told the judge at the hearing on Friday that there was no legal basis for the deportation of Abreco Garcia.

“They admit that they had no legal permission to remove it to El Salvador,” Moshenberg said. “The public interest is that the government must comply with the law.”

Erez Reuveno, a government lawyer, admitted that Vugo Garcia should not have been deported.

Xinis questioned the government’s lawyer about the judicial authority he had to arrest and stop open Garcia.

“Why can’t the United States bring back Mr. Abrego Garcia?” Xinis asked.

Reuveno said he asked the US government this question, but did not receive an answer that he considered satisfactory.

The audience marks the latest critical point in the Trump government’s oppression of immigration.

On March 15, Trump invoked the Foreign Enemies Act from 1798 to quickly deport alleged members of the Venezuelan gang Tren de Aragua. The government said it sent two flights to El Salvador that day with prosecutors, under the status that was rarely used in war times, and a third flight that transported deported people according to other rules.

An employee of the US immigration and customs department, in a mood, said that Abrego Garcia was incorrectly placed on the third flight, despite a court decision in October 2019 which provided him with protection against deportation.

Abreago Garcia was stopped and arrested by Ice officials on March 12 and asked about his alleged connection to a bunch. Vago Garcia questioned the government’s statement that he would be a member of the gang MS-13.

His lawyers, who also represent his wife and five -year -old son in the United States, said in a trial that the United States did not take any voluntary action “to correct what they themselves describe as a mistake.” The wife and son of Abreco Garcia are American citizens.

The prominent company Fenn Emanuel Law Firm joined Abrego Garcia Legal Team on Friday before the hearing began. Among the company’s customers, the billionaire is businessman Elon Musk, an important adviser for Trump.
